The general terms and conditions of sale (GTCS) detailed below apply to all offers made on the www.art2paris.com website and govern the contractual relationship between any user of the website and the commercial brand ART2PARIS, headquartered at 184 Quai Adrien Mentienne 94360 Bry Sur Marne, Grand Paris , France and registered with the Créteil Trade and Companies Registry under number 947598694 (hereinafter referred to as ART2PARIS).


2. PURPOSE OF THE CONTRACT

The purpose of the present general terms and conditions of sale is to set out the contractual provisions between ART2PARIS and the customer and the conditions applicable to any purchase made through the www.art2paris.com merchant site, whether the customer is a professional or a consumer.

The acquisition of a good or service through the present site implies unreserved acceptance by the customer of the present terms and conditions of sale.

The customer declares that he/she has read and accepted these terms and conditions of sale before placing an order. Any order therefore implies acceptance of our current terms and conditions of sale. All other terms and conditions of sale shall not apply unless waived in writing by ART2PARIS.

Certain conditions are subject to change and may be modified in the future. Visitors to the site must therefore read them before each visit or before placing an order on the www.art2paris.com website.

These modifications are enforceable from the date they are put online (date of online publication available at the end of the page of these GCS).

4. CHARACTERISTICS OF PRODUCTS OFFERED FOR SALE

ART2PARIS products are based on artists' works, available in different formats and finishes, according to the agreements made with the artist or his agent.

The photographs in the catalog are as accurate as possible, but cannot guarantee a perfect similarity with the item offered, particularly as regards colors. Each individual computer screen has its own nuances of color.

As part of the digigraphy process, all products are produced in limited editions, numbered and signed by the artist (* signature only on the collector's edition, 30 copies maximum).

Products produced in "Digigraphie quality" do not constitute true Digigraphie according to the terms and conditions defined in the label by Epson, but this quality assures you that the print has been produced under the same technical conditions (pigment ink...).

Prices are subject to change at any time, and products are invoiced at the rate in force at the time the order is placed.

Products remain the property of ART2PARIS until full payment of the price indicated in the order and on the invoice.

Prices do not include delivery charges.

5. RATES

The prices shown in the catalog are inclusive of VAT in euros, applicable on the date of the order. Any change in the rate may be reflected in the price of the articles. ART2PARIS reserves the right to modify its prices at any time, it being understood that the price appearing in the catalog on the day of the order will be the only price applicable to the customer.

6. GEOGRAPHICAL AREA

The online sale of products presented on the www.art2paris.com website is reserved for buyers residing in metropolitan France and Corsica.

7. ORDER

Your order from ART2PARIS constitutes an offer of a sales contract.

After placing an order with ART2PARIS, you will receive an acknowledgement of receipt by e-mail specifying the details and terms of your order. This acknowledgement does not yet constitute acceptance of your order by ART2PARIS. The sales contract is only concluded when ART2PARIS dispatches the goods. Consequently, items in an order that are not listed on the delivery documents do not constitute a valid sales contract.

The customer is reminded that ART2PARIS is a craftsman and does not sell the products offered in large quantities.

In addition, all numbered limited edition products may be sold out between stock updates on the www.art2paris.com website.

How do I place an order?

Customers must complete the following order process:

From the artwork, you can access its product sheet and its various variations.

Choose the format, then the support and finally the finish.

Add your products to your basket. Once you have validated your basket, you will be asked to log in by creating your customer account.

You must provide all the contact details requested when creating your account.

Choose your delivery method and accept the terms and conditions.

At any time during the ordering process, the customer can view the details of his order and its total price, and correct any errors, before confirming it to express his acceptance.

ART2PARIS reserves the right to cancel or refuse any order from a customer with whom there is a dispute over payment of a previous order.

Any order implies acceptance of the prices and descriptions of the items available for sale.

ART2PARIS undertakes to honour orders received on the website only while stocks last.

8. PAYMENT METHOD

Payment for purchases is made by credit card (Carte Bleue, Visa, Mastercard) via the Stripe payment module.

9. PRODUCTION AND DELIVERY TIMES

ART2PARIS is a craftsman whose job is to manufacture the products sold on the www.art2paris.com website on request.

As a result, there are 2 lead times to be taken into account: The manufacturing lead time, which is indicated on the product sheet, and the delivery lead time, which is indicated when choosing the delivery method.

All orders placed on the www.art2paris.com website before midnight (GMT +1h) from Monday to Friday and on Sundays (excluding public holidays) will be prepared and dispatched within 48 hours, subject to stock availability and payment validation.

Stock availability is visible on the product page selected in the product data sheet.

The delivery time is between 24 and 72 hours, depending on the delivery mode chosen, for delivery in mainland France.

ART2PARIS undertakes to deliver orders placed by the customer within the agreed delivery times. If the said items have not been delivered within 15 working days of the delivery date specified in the order, and if this delay is not due to force majeure, the customer may cancel the sale by sending a registered letter with acknowledgement of receipt to the following address: ART2PARIS 184 Quai Adrien Mentienne Bry Sur Marne . The sums paid by the customer will then be reimbursed in full.

The customer has a period of 1 month from the date of dispatch of the order to report non-receipt and request cancellation of the sale and reimbursement of the items.

After this period, no cancellation of the sale will be accepted.

10. RECEIPT OF ORDERS

The customer is obliged to check that the items delivered are in good condition. Any anomaly noted (missing item, damaged package, broken item, etc.) must be reported within 48 hours of receipt.

The customer must open the parcel(s) in the presence of the carrier or at the parcel relay and may refuse delivery if he/she finds that the product(s) is/are damaged. A parcel cannot be refused simply on the basis of damaged packaging.

If the customer does not personally receive the order, the person in charge of receiving it should carry out the same checks on the good condition of the products.

Whatever the carrier, it is not obliged to deliver inside your home, as delivery is made to the foot of the building or to your home.

In the event of a return on the grounds of damaged packaging, even though the products inside are intact, the customer will be responsible for the cost of reshipment. These costs are the same as for the original order.

If the customer decides to cancel the order after the product(s) has (have) been returned, the shipping costs remain at the customer's expense and will be deducted from the refund amount.

Receipt of transported products extinguishes any action against the carrier or ART2PARIS if the usual reserves for damage or partial loss have not been noted on the carrier's receipt slip.

11. WITHDRAWAL PERIOD

The customer, a non-professional individual, benefits from a withdrawal period of fourteen days from receipt of the order to return the product(s).

To do so, he/she must contact our customer service department, which will inform him/her of the procedure to follow to return the product(s).

Similarly, no returns, for whatever reason, will be accepted on a cash-on-delivery basis.

CONDITIONS OF EXCHANGE AND RETURN FOR REFUND

Returned items must be new, in perfect condition and in their original packaging.

Items returned without their original packaging or incomplete, damaged or soiled by the customer will not be accepted for exchange or refund.

Return postage is at the customer's expense. (colissimo signature required)

Likewise, no returns, for whatever reason, will be accepted on a cash-on-delivery basis.

In the event of a product error on the order, ART2PARIS is responsible for return shipping costs.

13. FORCE MAJEURE

In application of article 1148 of the French Civil Code, ART2PARIS cannot be held responsible or considered to have committed a fault in the processing of your file, if any delay or non-performance results from a case of force majeure.

The automated processing of nominative information has been declared to the Commission Nationale de l'Informatique et des Libertés under number 1806515.
